These Terms govern the mutual rights and obligations of the seller and a natural person who concludes a purchase agreement outside their business activity as a consumer, or within their business activity (the “Buyer”) through the web interface of the online store available at mindsetstore.eu.
The provisions of these Terms form an integral part of the purchase agreement. Deviating arrangements in the purchase agreement take precedence over these Terms.
II. Information on Goods and Prices
Information about goods, including prices and main characteristics, is provided for each product in the online store catalog. Prices include VAT and all related fees. Prices remain valid for the period displayed in the online store.
Product presentations are informative and do not constitute an offer to conclude a contract. Information on packaging and delivery costs is provided in the store. Discounts cannot be combined unless agreed otherwise.
III. Order and Conclusion of the Purchase Agreement
The Buyer places orders via a registered account or order form without registration. Before submission, the Buyer may check and modify the order. The order is submitted by clicking the purchase button.
After receiving the order, the Seller sends confirmation by email. The purchase contract is concluded upon confirmation of the order by the Seller.
If the Seller cannot meet the order, an amended offer is sent and the contract is concluded upon Buyer acceptance. Orders are binding. Obvious technical pricing errors are not binding on the Seller.
IV. Payment and Delivery Terms
Payment methods include online card payments. The Buyer also pays delivery costs. The Seller issues a tax document (invoice) sent electronically.
Goods may be delivered to the address provided, a pickup point, or collected in person. Ownership passes to the Buyer upon full payment and receipt of goods.
V. Withdrawal from Contract
Consumers have the right to withdraw within 14 days from receipt of goods, unless exceptions apply (e.g., custom goods, perishable goods, sealed hygienic goods, digital content, etc.).
The Buyer must notify the Seller within the withdrawal period and return goods within 14 days. The Seller refunds payments within 14 days after withdrawal, using the same payment method unless agreed otherwise.
VI. Rights from Defective Performance
The Seller is liable that goods are free from defects upon receipt. The Buyer may exercise defect rights within 24 months. In case of defects, the Buyer may request replacement, repair, discount, or withdrawal depending on severity.
Complaints must be handled without undue delay, no later than 30 days unless agreed otherwise.
VII. Delivery of Documents
The parties may communicate electronically. The Buyer delivers correspondence to the Seller’s email and vice versa.
VIII. Personal Data
All information provided by the Buyer is confidential. Personal data is processed solely for contract fulfillment unless the Buyer consents otherwise. Marketing messages may be sent unless explicitly refused. Detailed information is provided in the Privacy Policy.
IX. Out-of-Court Dispute Resolution
Consumer disputes may be resolved by the Czech Trade Inspection Authority (ČOI) or via the EU online dispute resolution platform. The Seller is authorized to sell goods under a trade license and is supervised by relevant authorities.
X. Final Provisions
All relations are governed by Czech law. The Seller may amend these Terms. The purchase agreement is archived electronically and not publicly accessible.
Effective date: 1 January 2026 (latest version).
